Please take notice that the claims process in the above-referenced receivership action has begun and pursuant to the Court’s instructions, the Receiver has set February 28, 2018 as the Claims Bar Date for the submission of claims. Any person who believes they have a claim of any type against BIC REAL ESTATE DEVELOPMENT CORPORATION; HOME SWEET HOLDINGS dba PROPERTY MANAGEMENT OF BAKERSFIELD; WM PETROLEUM; TARGET OIL & GAS DRILLING, INC.; TIER 1 SOLAR POWER COMPANY; or TIER 1 SOLAR POWER COMPANY, LLC; or their subsidiaries and affiliates, must send a completed Claim Form to David P. Stapleton, Receiver, to submit a claim. Do not file your claim with the Court. Claim Forms must be received by the Receiver on or before February 28, 2018, at 5:00 PM P.S.T. or you may lose your right to receive any distribution from the Receivership Estate and your claim may be forever barred.
Claimants are invited to submit claims pursuant to the Notice of Claims Process & Instructions, which have been delivered to creditors via email and posted to this website, and to submit any eligible claims via the associated Claim Form, which have also been emailed to creditors and posted to this website. The Receiver is also providing a guide with instructions to assist you with completing the Claim Form and W-9, and a reference to the Net Contribution amount determined by the Receiver’s Accounting Report which was filed on February 24, 2017. David P. Stapleton (the “Receiver”) is the Court-appointed receiver in the above-referenced case. He is responsible for reviewing Claim Forms, and when appropriate, objecting to claims. The purpose of the Claim Form is to help the Receiver learn who you are, how much you are owed, the reason(s) you have a claim, and how the Receiver can contact you. Unless otherwise ordered by the Court, if you fail to submit a Claim Form by February 28, 2018, you may lose your right to receive any distributions from the Receiver or the receivership estate and your claim may be forever barred. Failure to submit a signed Claim Form and supporting documentation may result in the denial of your claim.
